Preamble
These General Terms and Conditions of Sale (hereinafter "T&Cs") govern sales made on the site https://www.millapoignees.fr (hereinafter the "Site").
The Site is published and operated by SAS MILLA (hereinafter "MILLA" or "the Seller"). The terms "you", "your" and "the Customer" designate the person placing an order on the Site.
The T&Cs apply exclusively to consumers (natural persons acting for non-professional purposes). For any enquiry relating to a professional purchase, please contact us.
By validating an order on the Site, the Customer acknowledges having read the T&Cs and accepts them without reservation.

Article 2 – Products
The products offered for sale are those shown on the Site on the day of the order, subject to available stock or availability from our suppliers when the product is manufactured/supplied to order.
Each product page presents the essential characteristics. Photographs and visuals are provided for illustration purposes: slight variations (colour, material finish) may exist depending on screens and lighting.
Article 3 – Price
Prices are shown in euros, inclusive of all taxes (TTC), excluding delivery charges (unless otherwise stated). Delivery charges are shown before final validation of the order.
MILLA reserves the right to modify its prices at any time. The price charged is the price displayed at the time the order is validated, subject to availability.
Retention of title: the products remain the property of MILLA until full payment of the price.
Article 4 – Order & contract formation
The Customer selects the products, checks their basket, then enters the information required for delivery and invoicing. The Customer may correct any errors before final validation.
The order becomes final after validation of payment (or confirmation of payment receipt depending on the method used). An order confirmation is sent by email.
Important: the Customer is responsible for the accuracy of the information provided (address, email, telephone). In the event of an error resulting in a return or re-dispatch, the corresponding costs may be charged.
MILLA reserves the right to refuse or cancel an order in the event of a previous dispute, payment incident, or suspected fraud.
Article 5 – Availability
Offers are valid as long as they are visible on the Site, subject to available stock and/or supply capacity.
In the event of unavailability after an order is placed, MILLA informs the Customer and proposes, as appropriate, a new delivery time, an alternative, or cancellation with refund of sums paid for unavailable products.
Article 6 – Payment & security
Payment is made via the methods offered on the Site (bank card, bank transfer, PayPal, etc. depending on availability).
Card payments are processed via a payment service provider: bank details are exchanged via encrypted channels. MILLA does not have access to your complete card number.
In the case of payment by PayPal, the PayPal service conditions apply.
Article 7 – Delivery
Delivery areas and available delivery methods are indicated when placing an order. We deliver notably to mainland France and, depending on options, to other destinations (Belgium, Luxembourg, Switzerland, French overseas territories, Europe, etc.).
Timescales: preparation and delivery times vary according to (i) product availability (in stock / to order), (ii) carrier, (iii) destination. The times displayed are estimates. Some items may depend on the production schedule of our workshops/suppliers.
Tracking: a tracking link is sent when the shipment is registered. Delivery may take place without prior notice from the carrier: the Customer must ensure that someone is present to receive the parcel or choose delivery to a collection point when offered.
Receipt: on delivery, the Customer is invited to check the condition of the parcel and the conformity of the products. In the event of an anomaly (damaged parcel, missing product, wrong reference), please contact MILLA as soon as possible with photographs in order to open a file and offer an appropriate solution.
Transfer of risk: in the context of a distance sale, the risk of loss or damage is transferred to the consumer when the consumer (or a designated third party, other than the carrier) takes physical possession of the goods.
Customs / taxes outside EU: for deliveries outside the European Union, duties and taxes may be required on arrival and remain the responsibility of the recipient.
Article 8 – Right of withdrawal & returns
8.1 Statutory right of withdrawal (14 days)
In accordance with the Consumer Code, the Customer has a right of withdrawal of 14 days from receipt of the products (or the last batch in the case of split delivery), without having to give reasons for their decision.
To exercise this right, the Customer must notify their decision by means of an unambiguous statement to contact@millapoignees.fr. The Customer must then return the products no later than 14 days following notification of withdrawal.
8.2 MILLA commercial extension: 90 days
Because a project can take time, MILLA extends the return period on a commercial basis to 90 days from receipt (subject to statutory exceptions below). This extension does not affect the conditions relating to the condition of returned products.
8.3 Return acceptance conditions
Returns are checked manually by our team. We check each return individually, with care. For the return to be accepted, products must:
- be complete (all parts, screws, accessories, instructions),
- be unused and not fitted,
- be returned in their original packaging, clean, and in resaleable condition.
Packaging: handles are finishing pieces. Metal-to-metal friction causes scratches. Please return items protected as when dispatched (padding, protection, and, if you received the pair assembled, return assembled and protected).
In the event of signs of installation, scratches, wear, missing parts or insufficient packaging, MILLA may refuse the return or apply a reduction corresponding to the depreciation of the product, in accordance with applicable rules.
8.4 Return costs
Unless there is a preparation error or proven defect, return costs remain the responsibility of the Customer. The return must be sent with tracking. The tracking number may be communicated by email.
8.5 Refund
8.5.1 Refund under the statutory right of withdrawal (14 days)
When the Customer exercises their statutory right of withdrawal within the fourteen (14) day period, MILLA refunds the sums paid, including delivery charges corresponding to the standard mode offered (excluding any additional cost of a more expensive mode chosen by the Customer), no later than fourteen (14) days from the date on which MILLA is informed of the withdrawal decision.
MILLA may defer the refund until recovery of the goods or until the Customer has provided proof of dispatch of the goods, whichever is the earlier.
The refund is made via the original payment method, unless otherwise agreed between the Parties.
8.5.2 Refund under MILLA commercial extension (up to 90 days)
When the return is made beyond the statutory withdrawal period, but within the commercial extension period of ninety (90) days offered by MILLA, the return is processed under this commercial policy.
After receipt and inspection of the return (complete products, unused, not installed, in resaleable condition and in their original packaging), MILLA proceeds, according to the Customer's choice where possible, either with a refund or with the issue of a credit note. Processing is carried out within a reasonable time, generally between seven (7) and fourteen (14) working days, which may be extended during busy periods.
8.6 Exceptions to the right of withdrawal
The right of withdrawal does not apply, in particular, to goods made according to the Customer's specifications or clearly personalised. In particular, this concerns products made to order / to order when this is indicated on the product page or when ordering (e.g. certain references manufactured in the workshop or by manufacturers to order).
By way of indication, certain products from brands such as Mandelli, Dauby, Ento, DCG Laiton, Enrico Cassina may fall into this category when they are manufactured/supplied specifically for your order. If in doubt before purchase, contact us: we will respond according to the reference concerned.

Article 9 – Statutory guarantees
9.1 Legal guarantee of conformity
MILLA is bound by the statutory guarantee of conformity under the conditions provided for by the Consumer Code (articles L.217-3 et seq.). In the event of lack of conformity, the Customer may request that the goods be brought into conformity (repair or replacement) or, failing that, a price reduction or cancellation of the contract, under statutory conditions.
9.2 Guarantee against hidden defects
The Customer may also take action under the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). The Customer who proves the existence of a hidden defect may choose between cancellation of the sale or a price reduction, in accordance with statutory provisions.
9.3 Implementation procedures
For any request under the guarantees, please contact contact@millapoignees.fr stating the order number and attaching photographs/videos that enable the problem to be noted. Depending on the case, a product return may be requested before processing.
Article 10 – Preparation error / non-conformity with order
In the event of an error attributable to MILLA (wrong reference, incorrect quantity), MILLA covers the costs necessary for the return and/or re-dispatch, after validation of the file with the Customer.
Article 11 – Personal data
Personal data is processed by SAS MILLA, data controller. It is used to process orders, manage customer relations, and, if the Customer has consented, send communications.
The Customer may exercise their rights (access, rectification, deletion, objection, limitation, portability) by writing to contact@millapoignees.fr.

Article 12 – Intellectual property
The content of the Site (text, photographs, visuals, logos, descriptions, etc.) is protected by intellectual property law. Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written authorisation from MILLA and/or its successors in title, is prohibited.

Article 13 – Liability
MILLA implements reasonable means to ensure access to the Site and the quality of the information made available. MILLA's liability cannot be engaged in the event of non-performance attributable to the Customer, force majeure, or an external event that cannot be controlled.
Links to third-party sites may be provided. MILLA is not responsible for the content of these sites.

Article 15 – Mediation & dispute resolution
This contract is governed by French law. The language of the contract is French.
In the event of a dispute, the Customer is invited to contact MILLA as a priority in order to seek an amicable solution.

In accordance with the provisions relating to consumer dispute mediation, the Customer may use the AME CONSO mediation service free of charge within one year from the date of the written complaint addressed to MILLA:

Article 16 – Force majeure
MILLA's liability cannot be engaged if non-performance or delay in performance of one of its obligations results from force majeure within the meaning of case law and the Civil Code. MILLA will inform the Customer as soon as possible when the situation impacts the execution of the order.
