These General Terms and Conditions of Sale, hereinafter referred to as the "GTC", apply to orders placed on the website www.millapoignees.fr.

Before placing any order, we also invite you to consult our Returns and Refunds, Privacy Policy and Legal Notice pages.


Preamble

The website www.millapoignees.fr, hereinafter referred to as the "Site", is published and operated by the company SAS MILLA, hereinafter referred to as "MILLA" or "the Seller".

The terms "you", "your" and "the Customer" refer to any person placing an order on the Site.

These General Terms and Conditions of Sale apply primarily to sales concluded with consumers, meaning natural persons acting for purposes that do not fall within the scope of their commercial, industrial, craft, professional or agricultural activity.

For any order placed in a professional capacity, in particular by an architect, interior designer, fitter, joiner, construction company, reseller or any other professional structure, we invite you to contact us before placing an order so that the applicable terms can be discussed.

By validating an order on the Site, the Customer acknowledges having read these General Terms and Conditions of Sale and accepts them without reservation.

For any comments regarding the operation of the Site, an order or a product, the Customer may contact MILLA via the contact form.


Article 2 – Products

The products offered for sale are those presented on the Site on the date of the order, subject to available stock or availability from our suppliers, manufacturers, factories or partner workshops.

Each product page sets out the essential characteristics of the product: model, finish, fitting type, dimensions where indicated, composition, intended use or any other information useful to the Customer's choice.

Photographs, visuals, colour renderings and lifestyle images are provided for illustrative purposes only. Slight variations may exist depending on screens, lighting, finishing processes, materials or manufacturing methods.

Certain products may be manufactured, prepared or sourced specifically at the Customer's request. Where this is the case, the information may be indicated on the product page, at the time of ordering or during exchanges with our team.

If in doubt about a reference, a finish, technical compatibility or a specific use, the Customer is invited to contact MILLA before placing an order.


Article 3 – Prices

Prices are shown in euros, inclusive of all taxes, excluding delivery costs, unless otherwise stated.

Delivery charges are indicated before the final confirmation of the order. They vary depending on the carrier chosen, the destination, the weight, the volume of the parcel and the available options.

MILLA reserves the right to modify its prices at any time. The price charged to the Customer is that displayed at the time the order is validated, subject to product availability.

Retention of title: products remain the property of MILLA until full payment of the price by the Customer.


Article 4 – Order and Formation of Contract

The Customer selects the products of their choice, adds them to their basket, checks the details of their order, then enters the information required for billing and delivery.

Before final validation, the Customer may check the contents of their basket, correct any errors, amend their details or abandon their order.

The order becomes firm after payment has been validated or confirmation of payment receipt has been acknowledged according to the payment method used. An order confirmation is then sent by e-mail to the address provided by the Customer.

Important: the Customer is responsible for the accuracy of the information provided at the time of ordering, in particular the delivery address, e-mail address and telephone number. In the event of an error resulting in a return, failed delivery or re-shipment, the corresponding costs may be charged to the Customer.

MILLA reserves the right to refuse or cancel an order in the event of a prior dispute with the Customer, a payment incident, suspicion of fraud, a manifest error in the price or an order of an abnormal nature.


Article 5 – Product Availability

Product offers are valid for as long as they are visible on the Site, subject to available stock and supply capacity from our suppliers, manufacturers or partner workshops.

It may happen that a product displayed as available or orderable becomes unavailable after the order has been validated, in particular in the event of a stock discrepancy, supplier stock-out, extended manufacturing lead time or discontinued production.

In the event of unavailability after an order has been placed, MILLA will inform the Customer as soon as possible and may offer, depending on the situation:

  • a new delivery date;
  • an equivalent product or an alternative;
  • partial or total cancellation of the order;
  • the refund of amounts paid for unavailable products.

In the event of cancellation due to unavailability, the refund will be made within a maximum period of fifteen (15) days from the date on which MILLA becomes aware of the unavailability.


Article 6 – Payment and Security

Payment is made via the methods available on the Site at the time of ordering, including by credit card, PayPal or any other available payment method.

Credit card payments are processed by a secure payment service provider. Banking details are transmitted via encrypted channels and are not accessible to MILLA.

MILLA never has access to your full credit card number.

In the event of payment by PayPal, PayPal's own terms and conditions of service also apply.

The order will only be prepared once payment has been effectively validated, unless a specific agreement has been reached between MILLA and the Customer.


Article 7 – Delivery

Delivery areas and available delivery methods are indicated during the checkout process.

MILLA delivers in particular to mainland France and, depending on available options, to several European countries as well as certain overseas territories.

7.1 Preparation and Delivery Times

The delivery times indicated on the Site are estimates. They may vary depending on product availability, the production schedule, the chosen carrier, the destination, periods of high activity or events beyond MILLA's control.

Some products may depend on the production schedule of our suppliers, factories or partner workshops. In such cases, the lead time may be longer than for a product held in stock.

MILLA does its utmost to dispatch orders as quickly as possible, but cannot guarantee the complete absence of delays, particularly where these depend on a supplier, a workshop or a carrier.

7.2 Delivery Tracking

When the order has been dispatched, a tracking link or number is sent to the Customer, where the carrier allows this.

Delivery may take place without prior notice from the carrier. The Customer must therefore ensure that a person is available to receive the parcel, or opt for delivery to a collection point where this option is available.

7.3 Receipt of Parcel

Upon delivery, the Customer is invited to check the apparent condition of the parcel and the products.

In the event of a visible anomaly, in particular a damaged parcel, an opened parcel, a missing product, a broken product or an incorrect reference, the Customer must contact MILLA as soon as possible at contact@millapoignees.fr, attaching photographs of the parcel, the shipping label, the inner packaging and the products concerned.

Where possible, the Customer is also invited to note any reservations with the carrier.

7.4 Transfer of Risk

In the context of a distance sale to a consumer, the risk of loss or damage to products is transferred to the Customer at the moment when they, or a third party designated by them other than the carrier, physically takes possession of the goods.

7.5 Customs and Taxes outside the European Union

For deliveries outside the European Union, customs duties, local taxes, administrative fees or other charges may be payable upon arrival in the destination country.

These charges are the responsibility of the recipient and are not included in the price paid on the Site, unless explicitly stated otherwise.


Article 8 – Right of Withdrawal, Returns and Refunds

8.1 Statutory 14-Day Right of Withdrawal

In accordance with the French Consumer Code, the consumer Customer has a statutory withdrawal period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to justify their decision.

Where an order covers several products delivered separately, the withdrawal period runs from receipt of the last product.

To exercise the right of withdrawal, the Customer must notify MILLA of their decision by a clear and unambiguous statement, sent by e-mail to contact@millapoignees.fr.

The Customer must then return the products no later than fourteen (14) days following notification of their decision to withdraw.

8.2 MILLA Commercial Extension: returns up to 90 days

Because a renovation project can take time, MILLA offers a commercial extension of the return period of up to ninety (90) days from receipt of the order.

This commercial extension only applies subject to compliance with the return conditions set out in these General Terms and Conditions of Sale and in the Site's returns policy.

It does not apply to products excluded from the right of withdrawal, in particular personalised products, products made to the Customer's specifications, or products manufactured specifically at the Customer's request where this information is indicated.

8.3 Return Acceptance Conditions

Returns are checked manually by our team. Each returned product is carefully inspected.

To be accepted, a return must meet the following conditions:

  • products must be complete: all parts, screws, accessories, instructions and supplied items must be returned;
  • products must be unused and unassembled;
  • products must be clean, unscratched, undamaged and in a resalable condition;
  • products must be returned in their original packaging, with the protective materials provided at the time of dispatch;
  • the return parcel must be sufficiently protected to avoid any damage during transit.

Handles are finishing components. Metal-on-metal friction can cause scratches. The Customer must therefore carefully protect each item before returning it, avoiding any direct contact between metal parts.

In the event of a returned product that is incomplete, scratched, assembled, used, damaged, inadequately protected or not in a resalable condition, MILLA may refuse the return or apply a depreciation deduction corresponding to the observed loss in value.

8.4 Return Costs

Unless the error is attributable to MILLA or a proven product defect, return costs are the responsibility of the Customer.

The return must be sent using a tracked delivery method. The tracking number must be retained by the Customer and may be communicated to MILLA by e-mail.

8.5 Refund under the Statutory Right of Withdrawal

When the Customer exercises their statutory right of withdrawal within the fourteen (14) day period, MILLA refunds the amounts paid, including the delivery costs corresponding to the standard delivery method offered, excluding any additional costs resulting from the choice of a more expensive delivery method.

The refund is made no later than fourteen (14) days from the date on which MILLA is informed of the decision to withdraw.

MILLA may defer the refund until the goods have been recovered or until the Customer has provided proof of dispatch of the goods, whichever occurs first.

The refund is made via the original payment method, unless otherwise agreed between MILLA and the Customer.

8.6 Refund under the 90-Day Commercial Extension

When the return is made beyond the statutory withdrawal period of fourteen (14) days, but within the commercial return period of ninety (90) days offered by MILLA, the return is processed under this commercial policy.

After receipt and inspection of the returned products, MILLA may offer, depending on the situation and where possible, a refund or a credit note.

Returns are generally processed within seven (7) to fourteen (14) working days of receipt of the parcel at our premises. This period may be extended during periods of high activity or if additional verification is required.

8.7 Products excluded from the right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to goods made to the Customer's specifications or clearly personalised.

Products particularly concerned include personalised, bespoke or custom-made products manufactured specifically at the Customer's request, or products subject to a particular configuration where this information is indicated on the product page, at the time of ordering or during exchanges with our team.

By way of illustration, certain brand or manufacturer references such as Mandelli, Dauby, Ento, DCG Laiton or Enrico Cassina may fall into this category when they are manufactured, configured or sourced specifically for the Customer's order.

If in doubt before purchasing, the Customer is invited to contact MILLA in order to obtain a response regarding the relevant reference.

8.8 Return Address

The Customer must include in the parcel their first name, surname and order number, or the delivery note if available.

Article 9 – Statutory Warranties

9.1 Statutory guarantee of conformity

MILLA is bound by the statutory warranty of conformity under the conditions set out in Articles L.217-3 et seq. of the French Consumer Code.

In the event of a lack of conformity, the Customer may request that the product be brought into conformity, by repair or replacement, or, where the legal conditions are met, a reduction in price or cancellation of the contract.

9.2 Warranty against Hidden Defects

The Customer may also act under the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The Customer who proves the existence of a hidden defect may choose between cancellation of the sale or a reduction in price, in accordance with applicable legal provisions.

9.3 Exercising the Warranties

For any request under the statutory warranties, the Customer must contact MILLA at contact@millapoignees.fr, stating their order number and attaching photographs or videos allowing the problem to be identified.

Depending on the situation, MILLA may request the return of the product concerned before proposing a solution.

Statutory warranties do not cover damage resulting in particular from improper installation, misuse, inadequate maintenance, normal wear and tear, impact, product modification or use inconsistent with its intended purpose.


Article 10 – Preparation Error or Product Not in Conformity with the Order

In the event of an error attributable to MILLA, in particular an error in reference, quantity or a product manifestly not in conformity with the order, the Customer must contact MILLA as soon as possible at contact@millapoignees.fr.

After reviewing the file, MILLA will cover the costs necessary for the return and/or reshipment, depending on the solution chosen.

Photographs of the product received, the parcel label and the packaging may be requested in order to process the request efficiently.


Article 11 – Personal Data

The personal data collected on the Site is processed by SAS MILLA, as data controller.

They are used in particular to process orders, organise delivery, manage billing, monitor the customer relationship, handle returns and complaints, and, where the Customer has given their consent or where regulations permit, to send commercial communications.

The Customer has rights regarding their personal data, including the right of access, rectification, erasure, objection, restriction of processing and, where applicable, the right to data portability.

Article 12 – Intellectual Property

All content present on the Site, including texts, photographs, visuals, logos, graphics, product pages, descriptions, videos, layout structure and design elements, is protected by intellectual property law.

Unless otherwise stated, these contents are the exclusive property of MILLA or are subject to an authorisation of use.

Any reproduction, representation, modification, adaptation, distribution or exploitation, in whole or in part, without prior written authorisation from MILLA, is prohibited.

For any request to use content, in particular in the context of a press, architect, interior designer, partner or professional project, the Customer or relevant third party may contact MILLA at contact@millapoignees.fr.


Article 13 – Liability

MILLA implements reasonable means to ensure the proper operation of the Site, the accuracy of the information published and the proper fulfilment of orders.

MILLA's liability cannot be engaged in the event of non-performance or improper performance attributable to the Customer, a third party, a carrier, a supplier, a case of force majeure or an external event that cannot reasonably be controlled.

Photographs, colours and finish renderings are presented for illustrative purposes only. Slight differences may exist depending on screens, display settings, lighting or manufacturing processes.

The Site may contain links to third-party websites. MILLA is not responsible for the content, operation or privacy practices of these external sites.

We do our utmost to respond quickly and handle every request with care.


Article 15 – Mediation and Dispute Resolution

These General Terms and Conditions of Sale are governed by French law. The language of the contract is French.

In the event of a difficulty, the Customer is invited to contact MILLA as a priority in order to seek an amicable resolution.

In the majority of cases, an exchange by e-mail or telephone allows the situation to be resolved quickly. The Customer can write to contact@millapoignees.fr or call 01 75 36 64 32.

In accordance with the provisions relating to consumer dispute mediation, the Customer may use the mediation service of AME CONSO free of charge, within one year of the written complaint addressed to MILLA.

Failing an amicable resolution or mediation, the competent French courts may be referred to, subject to applicable legal provisions.


Article 16 – Force Majeure

MILLA's liability cannot be engaged if the non-performance or delay in performance of any of its obligations results from a case of force majeure within the meaning of the French Civil Code and applicable case law.

Events that may in particular constitute force majeure or external events disrupting the fulfilment of an order include: strike, natural disaster, fire, flood, epidemic, transport blockage, exceptional supply disruption, major breakdown, administrative decision or any other unforeseeable, unavoidable and external event.

MILLA will inform the Customer as soon as possible when the situation affects the fulfilment of their order.
